A contested estate or a will dispute is a type of estate litigation which is heard in the Supreme Court of New South Wales. Contested estates are also known as Family Provision Claims in New South Wales.

The basis for a Family Provision Claim is that a will is challenged by a person who thinks that they have not been left with an adequate provision by the deceased for their education, maintenance and advancement of life. Estate litigation is usually initiated by a person who has a close relationship with deceased such as spouse, de-facto partner or child. This sometimes also extends to siblings, parents, grandparents, grandchildren, nieces and nephews.

The ability to contest a will depends on a number of factors. These can include things such as the relationship with the deceased and your personal circumstances.

At Adams and Partners Lawyers, we can assist you by providing our advice as to your potential claim of challenging a will and assisting you through the legal process. We are able to quickly provide an assessment as to your potential estate claim and help you at every stage through the process.
