To ensure your loved ones are adequately provided for it is important that your will is regularly reviewed to make certain that it accurately reflects your circumstances and wishes.

Updating your will

We recommend your review your will in circumstances such as:

  1. Marriage or the commencement of a de facto relationship
  2. Divorce or separation
  3. Death of a spouse or de facto spouse
  4. Having children or grandchildren
  5. A change in your children or grandchildren’s circumstances, such as attaining 18 years of age, marriage, divorce, remarriage or having children of their own
  6. Death of a beneficiary under your will
  7. Death or illness of an executor of your will
  8. Buying or acquiring property (including money) not included in your existing will
  9. The sale or loss of property (including money) previously included in your existing will
  10.  A reduction in value of property (including money) included in your existing will
  11. A wish to reallocate a portion of your estate to an additional beneficiary such as a charity
  12. Three to five years have passed since you last reviewed your will
  13. Laws and regulations governing your will have changed.

How do I update my will?

There are a number of legal principles that govern the manner in which a will may be altered. These rules are complex and should an alteration be made that does not follow these rules, these alterations may not be taken into account when the time comes to distribute your property in accordance with your will.

Whilst there are a number of D.I.Y. kits and packages available, a will is ultimately a legal document. No matter how simple it may appear, there are complex and important legal principles involved.
